They form the contract basis between Cupido-Media B.V. (hereafter "CM") and performer and client. CupidoCam.com is a site which enables a performer to portray themselves on the internet and to communicate with clients at a charge.
These conditions are valid until they are changed. Users will be notified of any changes made and can choose to accept them online.
Privacy
Only data necessary to the handling and billing of the service of the performer to the clients will be collected. Along with this data other necessary data, such as contact data as well as session data, will be collected for individual business incidents.
Communication takes place directly between the performer and the client. Nevertheless, CM reserves the right to check single transmissions or to document the sessions. CM accepts no responsibility for the contents offered by the performer.
The billing of money spend by the clients for performers shows, will be conducted through a contracted third party. The billing data will only be used to execute this billing transactions.
Offer
CM simply offers a technical internet platform which enables performers and clients to build up a performance relationship. CM simply supports the performer technically by their performance production and provides the invoice layer.
The performer takes full responsibility for the contents (Audio, Video, Text etc.) transmitted to the Client.
Neither the performer or the client have the right of use of the internet site. CM does not guarantee the availability of the internet site. CM reserves the right to change and add to the site at any time.
Payment options
The following payment options are currently available on CupidoCam.com: credit card, electronic transfer and other electronical payment options. The client can select the paymentmethod. He then aquires an amount of coins. These coins can be used at the client´s own discretion for video chats with the performers. A refund of the aquired coins is, as a rule, not possible.
The price for the connection will be agreed with the performer and accepted by the client by entering the video chat. A contractural agreement between the performer and client comes into force. Both sides agree that the payment will take place over CupidoCam.com.
Access requirements
Because CupidoCam may contain material not suitable for minors, access to the membership area is limited to persons over 18 or the corresponding age according to the laws and regulations of your country of resident.
CM carries out age control of the performers by means of a copy of a picture personal id card.
Permission to use CupidoCam.com will only be permitted after a successful check. CM reserves the right to request further documents in order to proove authenticity.
The age check for clients is possible through a technical process. The exact method is described on CupidoCam.com.
Both performer and client have the responsibility to ensure that no minors receive access data to CupidoCam.com. The performer and viewer accept full responsibility for misuse of access data by a thrid party.
On grounds of a suspected missue of the performer´s or client´s account, CM reserves the right to carry out further authenticity checks. This can be in the form of requesting futher documents, direct contact or viewing video sessions.
Accounts of performers who are abused to advertise other webcam platforms are being closed down and all earned commissions will be withdrawn. This will be the case if other webcam portals are advertised as well as webcam services through free messenger software is offered to show webcam streams.
Liability
CM accepts no liability for the displayed or transmitted contents of the communication between the performer and client on CupidoCam.com
CM is liable, independantly from legal justification, only for damages which occur through gross negligence or intentianally conduct. This is valid for missing or non current information on CupidoCam.com as well in general part as in the performer profiles and for the technical equipment of the site. In particular, CM accepts no liability for data loss which occurs by downloading of the software from CupidoCam.com.
A contract exists between the client and CM in relation to the use of the Coin Account. Herewith is the liability limited to gross negligently or intentionally caused loss. CM accepts the liability for damages caused by simple negligence in violating an important main contractual duty or cardinal duty or the lack of a promised feature. (This does not include the attributes of the senders, because this contract does only exist between sender and visitor.) Above that liability for simple negligence is excluded. In the case of minor negligence in violating an important main contractual duty, the liability of CM is limited to the the amount which the client on average spends for a single session.
Salvatorical Clause
Should one or more of the rules of this user agreement not be valid or feasible, the remaining rules remain in force. The invalid rules will be replaced by rules which would have been agreed on by both parties, as if they had known about the invalidity in advance.
